1. Agreement to these Terms
These Terms of Use ("Terms") are an agreement between you and Sandra Ruiz Enterprises, LLC, the owner and operator of CuidCare ("CuidCare," "we," "us," or "our"). By accessing or using CuidCare, you agree to these Terms and our Privacy Policy. If you do not agree, do not use CuidCare.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use CuidCare. CuidCare is not intended for use by children.
3. Accounts and care spaces
You agree to provide accurate account information, protect your login credentials, and notify us of suspected unauthorized access. You are responsible for activity under your account.
A Family Lead or other authorized user may invite relatives, caregivers, and trusted participants into a shared care space. Users must respect assigned roles and permissions and may access or share only information they are authorized to use.
4. Caregiving, medical, and emergency disclaimer
CuidCare is an organizational and communication tool. It does not provide medical advice, diagnosis, treatment, professional caregiving services, medication administration, clinical monitoring, or emergency response. Information in CuidCare may be entered by users and may be incomplete, delayed, or incorrect.
Always verify medications, instructions, appointments, and care decisions with the appropriate healthcare professional or source. Never delay professional care because of information in CuidCare. If you believe someone is experiencing an emergency, call 911 or the appropriate local emergency service immediately.
5. Your content and permissions
You retain ownership of information, notes, images, documents, and other content you submit ("User Content"). You grant CuidCare a limited license to host, store, process, display, and transmit User Content only as needed to operate, secure, support, and improve the service.
You represent that you have the rights and permissions needed to provide User Content, including information about a care recipient or another person. You are responsible for choosing whom to invite and for removing access when it is no longer appropriate.
6. Free beta program
The CuidCare beta is provided free of charge for testing and feedback. Beta features may be incomplete, change without notice, contain errors, or be unavailable. We may limit participation, reset test data, or end the beta at any time.
If you provide suggestions or feedback, you permit us to use them without restriction or compensation, but we will not publicly identify you without permission.
7. Future subscriptions and one-month free trial
After the beta, CuidCare expects to offer paid access through the App Store and may offer eligible users a one-month free trial. The app will display the current price, subscription period, trial terms, included features, and renewal information before you confirm a subscription.
Unless cancelled before the trial or current subscription period ends, an auto-renewable subscription will renew and Apple will charge the payment method associated with your Apple Account. Apple manages billing, refunds, cancellation, and subscription settings under its terms. You can manage or cancel through your Apple subscription settings. Deleting CuidCare does not automatically cancel a subscription.
8. Acceptable use
You may not:
- use CuidCare unlawfully or violate another person’s privacy or rights;
- enter information you are not authorized to share;
- harass, impersonate, exploit, or harm another person;
- attempt to bypass permissions, access another account, or interfere with security;
- introduce malicious code, scrape the service, or overload its systems;
- reverse engineer or copy CuidCare except where law expressly permits; or
- use CuidCare to provide emergency, clinical, or professional medical services without appropriate independent systems and authorization.
9. CuidCare ownership
CuidCare, including its software, design, branding, text, and other materials excluding User Content, is owned by Sandra Ruiz Enterprises, LLC or its licensors and is protected by intellectual property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use CuidCare as intended.
10. Third-party services and Apple
CuidCare may rely on third-party services for hosting, authentication, communications, analytics, storage, and App Store functions. Those services may have separate terms.
For the iOS app, these Terms are between you and Sandra Ruiz Enterprises, LLC, not Apple. Apple is not responsible for CuidCare or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions relating to the iOS app.
11. Service changes and termination
We may add, remove, suspend, or change features. You may stop using CuidCare at any time. We may suspend or terminate access when needed to protect users or the service, comply with law, address misuse, or enforce these Terms. Account deletion is addressed in the Privacy Policy.
12. Disclaimers
To the fullest extent permitted by law, CuidCare is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted availability, error-free information, or that CuidCare will meet every caregiving need. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Sandra Ruiz Enterprises, LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use arising from CuidCare. Nothing in these Terms limits liability that cannot lawfully be limited.
14. Governing law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Any dispute not subject to a legally required alternative forum will be brought in a state or federal court located in Connecticut.
15. Changes to these Terms
We may update these Terms as CuidCare changes. We will post the updated Terms, revise the date above, and provide additional notice when required. Continued use after updated Terms take effect means you accept them, except where law requires another form of consent.
